Welcome to Hearthmere Studio! The terms "we", "us" and "our" refer to Hearthmere Studio. Hearthmere Studio operates this store and website, providing you, the customer, with access to digital content (digital art) and related features (the "Services"). Hearthmere Studio is powered by Shopify, which enables us to provide the Services to you.

By using our Services, you agree to be bound by these Terms. Please read them carefully, as they govern your rights regarding the use of digital goods and contain important information about the waiver of your right to a refund once access to the digital content has been provided.

SECTION 1 - ACCESS AND TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence. Our digital products are intended strictly for personal, non-commercial use unless otherwise agreed upon in a separate license.

SECTION 2 - DIGITAL PRODUCTS

We have made every effort to display our work as accurately as possible. However, given the digital nature of the products, the final appearance of the image depends on your monitor’s color reproduction and hardware settings. We do not warrant that the display on your device will be identical to the original. Product descriptions are subject to change at any time without notice.

SECTION 3 - ORDERS AND BILLING

Placing an order constitutes an offer to purchase. The transaction is considered complete once payment is successfully processed and access to the file is provided to you. As we operate from Poland, applicable taxes (VAT) may be added to the cost in accordance with the rules of your country of residence.

SECTION 4 - DIGITAL DELIVERY

No physical shipping of goods is performed. Delivery is deemed complete at the moment the digital file becomes available for download or is sent to your email address. We are not responsible for technical issues on the customer's side (e.g., lack of internet connection, insufficient disk space, or software incompatibility).

SECTION 5 - RIGHT OF WITHDRAWAL AND REFUNDS (IMPORTANT FOR EU)

According to EU consumer protection laws, the right of withdrawal (within 14 days) does not apply to digital content if the performance has begun with your prior express consent. By clicking "Buy" or "Download," you acknowledge that you understand that a refund for a digital product is not possible once access has been provided.

SECTION 6 - INTELLECTUAL PROPERTY AND LICENSE

When you purchase digital art, you are granted a non-exclusive license for personal, non-commercial use. You are prohibited from:

  • Reselling, copying, or distributing the digital files.

  • Using the works for commercial purposes without a specific license.

  • Using the works to train artificial intelligence (AI) models.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to third-party tools which we neither monitor nor control. We provide access to such tools ”as is” and shall have no liability arising from or relating to your use of optional third-party tools.

SECTION 8 - THIRD-PARTY LINKS

Our Services may contain links to third-party websites. We are not responsible for the content, accuracy, or privacy policies of any third-party materials or websites.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Hearthmere Studio is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Hearthmere Studio. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Hearthmere Studio, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Hearthmere Studio.
